Registration Any person wishing to join the club may be sponsored by a member. If the applicant does not know a member, then the application will be posted to an area of the website for review by a committee of the owners of the club. The owners of the club may at their sole discretion sponsor a new applicant. You agree to provide true and complete information about yourself in all required fields of the registration form. If any of your information changes, you agree to update your registration information as soon as possible. If we suspect that your registration information is not complete or accurate, or that you have otherwise violated this Agreement, your membership may be subject to suspension or termination, and you may be barred from using the Site Each registered member receives a password to use in conjunction with an email address. You are responsible for maintaining the confidentiality of your password and are fully responsible for all activities that occur under your password. You agree to immediately notify us of any unauthorised use of your password or account or any other breach of security. We will not be liable for any loss or damage arising from your failure to comply with this. Fees There is currently no membership fee.. We may offer new services to all members from time to time which require payment - either to us or to a nominated third party - on terms which will be communicated at the time. There will be a charge payable in relation to events we organise which will be communicated in advance. Privacy policy Our Privacy Policy forms part of this Agreement, and by agreeing to this Agreement, you also give your consent to the way we may handle your personal data as detailed in that policy. Rights and obligations of Membership All members may communicate with other members, post messages on the message boards, write and read messages, and read other members’ profile page information. If you choose to post content, you must agree to the “Rules of Conduct” posted below. You acknowledge that we may edit content and have the right to refuse or remove any content from the Site without notice. Rules of Conduct You understand that all information or other materials ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from which such Content originated. This means that you, and not MyChumsClub are entirely responsible for all Content that you upload, post, email, transmit or otherwise make available via the Site. MyChumsClub does not control the Content posted via the Site and, as such, does not guarantee the accuracy, integrity or quality of such Content. You understand that by using the Site and the Service, you may be exposed to Content that is offensive, indecent or objectionable. Under no circumstances will MyChumsClub be liable in any way for any Content, including, but not limited to, for any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Site and the Service. Without limiting the foregoing, MyChumsClub and its designees shall have the right to remove any Content that violates this Agreement or is otherwise objectionable. In this regard, you acknowledge that you may not rely on any Content created by MyChumsClub or submitted to MyChumsClub, including without limitation information in message boards and in all other parts of the Service. You acknowledge, consent and agree that MyChumsClub may access, preserve, and disclose your account information and Content if required to do so by law or in a good faith belief that such access preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce this Agreement; (c) respond to claims that any Content violates the rights of third-parties; (d) respond to your requests for customer service; or (e) protect the rights, property, or personal safety of MyChumsClub, other members and the public. Indemnity You agree to indemnify and hold MyChumsClub, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of Content you submit, post, transmit or make available through the Site or the Service, your use of the Site or the Service, your connection to the Site or the Service, your violation of this Agreement, or your violation of any rights of another. Intellectual Property You acknowledge that all copyright, trade marks, and other intellectual property rights in the Site and the Service are owned by MyChumsClub. By submitting any material to the content to the MyChumsClub.com, you grant us a worldwide, perpetual, non-exclusive, royalty-free, non-terminable licence to copy, modify, distribute, and create derivative works from that material. Reliance on Medical, Legal, Financial, Investment and Other Information We offer information on various subjects such as travel, financial matters and lifestyle; the information contained should not replace a consultation with a qualified expert in the field. We will not be liable for any loss you suffer as a result of relying on such content. Event Fees Please note that once payment of event fees has been made, there will be no refund (nor will we have any other liability to you) for your subsequent withdrawal. Disclaimer and Limitation of liability You expressly understand and agree that we disclaim all warranties of any kind, including the implied warranties of fitness for a particular purpose or the quality of any products, services, information or other material that may be available on or via the Site. From time to time we will make available links from the Site to third party sites. The member agrees that we shall not be responsible or liable in any way for the content, advertising or products available from such sites, the quality, functionality, suitability or legality of such sites or for any dealings that you may have, or the consequences of such dealings, with such third party site operators. Termination Entire Agreement This Agreement includes our Privacy Policy. Together they contain the whole of the agreement between us and a member concerning the Site and the Service. Changes to this Agreement We reserve the right to change the terms and conditions of this Agreement from time to time, and post the new version on the Site. When we do so, we will notify members of the fact that there are changed terms on the main screen (www.mychumsclub.com), and post a link to the new Agreement there. Assignment We reserve the right to assign this Agreement, and to assign or subcontract any or all of our rights and obligations under this Agreement. You may not without the written consent of MyChumsClub assign or dispose of this Agreement. Severability In the event that any term of this Agreement is held to be invalid or unenforceable by judicial decree or decision, the remainder of this Agreement shall remain valid and enforceable.
